1. Service Description
NodeSight provides real-time threat intelligence services through kernel-level monitoring of Tor exit relay traffic. Services include sensor deployment, managed monitoring, API-delivered threat alerts, and SIEM integration. The specific scope of services is defined in your Order Form or Service Agreement.
2. Eligibility
NodeSight services are available exclusively to authorized organizations — including enterprises, government agencies, managed security providers, and law enforcement organizations operating under applicable legal authority. Individual consumer use is not supported.
3. Account Obligations
You are responsible for maintaining the confidentiality of your API keys, credentials, and account access. You agree to notify NodeSight immediately of any unauthorized use. You are responsible for all activities conducted under your account.
4. Acceptable Use
You agree not to use NodeSight services to: violate any applicable law or regulation; conduct unauthorized surveillance of individuals; interfere with or disrupt the Tor network's operation; attempt to decrypt or intercept communications content; share threat intelligence data with unauthorized third parties; or reverse-engineer NodeSight's proprietary algorithms.
5. Intellectual Property
All intellectual property rights in NodeSight's technology — including but not limited to inference architectures, ensemble models, circuit correlation databases, and sensor software — remain the exclusive property of NodeSight, Inc. Your license is limited to using the services as described in your Service Agreement.
6. Data Rights
You retain all rights to your organizational data. NodeSight retains rights to anonymized, aggregated threat intelligence derived from sensor operations, which may be used to improve services and publish research. No customer-identifiable data is included in aggregated datasets.
7. Service Level Agreement
NodeSight commits to 99.9% uptime for managed monitoring services, measured monthly. Detection latency SLAs (where applicable) are specified in your Service Agreement. Credits for SLA breaches are calculated as described in the SLA Addendum.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NODESIGHT'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. NODESIGHT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Indemnification
You agree to indemnify NodeSight against claims arising from your use of the services, your violation of these terms, or your violation of any applicable law or third-party right.
10. Termination
Either party may terminate the agreement with 30 days written notice. NodeSight may suspend access immediately if you breach these terms. Upon termination, your access to the platform and threat intelligence data will be revoked. Forensic evidence data will be retained for 90 days unless otherwise specified.
11. Governing Law
These terms are governed by the laws of India. Disputes shall be resolved through binding arbitration in Bengaluru, India, under the rules of the Indian Arbitration and Conciliation Act.
